    These Terms of Service govern your access to and use of the Warmix website and email warmup platform.

    These Terms of Service ("Terms") are a legal agreement between you and Warmix Inc. ("Warmix", "we", "us", or "our"). By accessing or using our website and services (collectively, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

    1. Eligibility

    You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You represent that you have the authority to enter into these Terms and, if you use the Service on behalf of an organization, that you have authority to bind that organization.

    2. The Service

    Warmix provides tools designed to help improve email deliverability by automating warmup activity for connected email accounts. To use the Service, you may need to connect one or more email accounts (via OAuth or SMTP/IMAP) and configure warmup settings.

    You authorize us to access the connected account(s) and to send, receive, and process messages as needed to provide the Service. You are responsible for ensuring you have all necessary rights and permissions to connect and use any email account with the Service.

    3. Accounts and Security

    • You are responsible for maintaining the confidentiality of your login credentials.
    • You are responsible for all activity that occurs under your account.
    • You agree to promptly notify us of any unauthorized access or security incident.

    4. Subscriptions, Billing, and Taxes

    Certain features of the Service may require a paid subscription. Prices, plan details, and billing frequency are described on the pricing page or at checkout.

    • Payment processing: Payments may be processed by third-party providers (e.g., Stripe). Your payment information is handled by those providers under their terms and privacy policies.
    • Renewals: Subscriptions may renew automatically unless canceled before the renewal date.
    • Taxes: You are responsible for any applicable taxes, duties, or similar governmental assessments.

    5. Acceptable Use

    You agree not to misuse the Service. For example, you may not:

    • Use the Service to send spam, phishing, malware, or other harmful content.
    • Violate any applicable law or regulation (including anti-spam and privacy laws).
    • Infringe the rights of others, including intellectual property or privacy rights.
    • Attempt to gain unauthorized access to the Service or related systems.

    We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or that your use poses risk to the Service, other users, or third parties.

    The Service may integrate with third-party services (such as Google, Microsoft, and email providers). Your use of third-party services is governed by their own terms and policies, and we are not responsible for third-party services.

    7. Intellectual Property

    The Service, including software, design, text, graphics, and trademarks, is owned by Warmix or its licensors and is protected by intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or lease any part of the Service.

    8. Disclaimers

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    Email deliverability depends on many factors outside of our control (including provider policies, sending practices, content, and domain reputation). We do not guarantee any specific deliverability, inbox placement, revenue, or results.

    9. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, WARMIX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

    10. Indemnification

    You agree to defend, indemnify, and hold harmless Warmix and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or your violation of these Terms.

    11. Termination

    You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time if we reasonably believe it is necessary to protect the Service, other users, or third parties, or if you violate these Terms.

    12. Changes to These Terms

    We may update these Terms from time to time. If we make material changes, we will take reasonable steps to provide notice (for example, by posting an updated version on this page). Continued use of the Service after changes become effective means you accept the updated Terms.

    13. Governing Law

    These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
